Compliance with Community Association Documents

Community associations in the State of Texas are governed by State Laws, local and county municipal codes and their respective community association governing documents. 

The Board of Directors has the right to hire a managing agent to help manage with the day-to-day operations on their behalf. The managing agent will follow the community association governing documents and business process to provide the oversight of the compliance inspection process. The managing agent will conduct three inspections per month. On the spot inspections also occur.

  1. 1. Owners are responsible to cure the issue in 12 days of the date of the letter to avoid escalations. Owners can assign this responsibility to an agent or tenant, but are still responsible for any infractions. 

2. Notices- these will identify the general category related to the compliance issue that was identified.  In general, the cure date is 12 days from the date of the letter. There are times when the board identifies an escalation of a letter sequence or the nature of an infraction automatically escalates the compliance issue. These points are identified in the Fine Enforcement Policy. 

3. Violation Closed Notice- this can be issued if the compliance inspector views the infraction has not repeated. The compliance category can be reopened and escalated if the same infraction occurred in the preceding 6 month period. This is per state code. 

Only two pictures can be attached per notice. Please check the entire lot for the same or similar compliance issues, if applicable, to prevent additional notices. 

Top 10 Common Compliance Notice Categories:

1. Trash and Recycle carts in view of the public street or private alley. Cart service day- Monday. Store out of view by 5 pm Tuesday.

2. Landscape- Mow, Edge, Weed- Please review the Policy Manual attachment 9, section E2 f and g. Bermuda lawn, garden beds, mulch beds and xeriscape should be free of weeds.

> Weeds and grass should not grow into public sidewalks or private alleys. 

3. Trim shrubs neatly. Remove uneven limbs and branches. If the shrub is near a public sidewalk or alley- trim limbs that grow over the sidewalk or alley. Shrubs should not impeded ingress or egress. Shrubs should not cause damage to public or private property. 

4. Signs are not permitted in the streetscape. The streetscape is between the front sidewalk and the street. 

5. For Lease signs are not permitted. 

6. Water the Bermuda lawn to keep it healthy as permitted by the current watering schedule. Brown and dead spots are not permitted. 

7. Replace missing Bermuda sod. 

8. Spot paint the house if fading or peeling occurs. 

9. Repair and replace fence pickets. 

10. Keep your address visible to the front street. This is for emergency services. You can submit an Architectural Change Request to add house numbers in a different location if the landscape foliage is blocking the address. 


Phase I, Section 2 homes: These homes are responsible to water their streetscape tree and lawn. The addresses run between Cattle Baron and Charles Merle, near Blaze. Check your closing documents for the Section, lot and block. 

Common Misconceptions: 

> The HOA is targeting my house. 

The Management team is hired by the Board of Directors to complete at least three monthly inspections per month. During the growing season, we can issue between 100-250 notices per month. 

> The HOA is trying to make money off compliance notices

We typically only budget a small amount in this category. We hope that all residences remain in compliance and are not cited. 

> Management staff get bonuses for compliance notices

Management pay is based on industry standards. It is not tied to notices that are issued.
